Summary: we collect what we need to manage your reservation, we never sell your data for money, marketing cookies are off unless you turn them on, and we honor Global Privacy Control. The full policy below governs.
1. Who we are
This Privacy Policy explains how Roadster (“we,” “us” or “our”) collects, uses, discloses and protects personal information when you visit roadster-preorder.us (the “Site”), request or hold a reservation, or otherwise communicate with us (together, the “Services”).
We are the business (or “controller”) responsible for your personal information. This policy is written for people in the United States. The Services are not directed to people outside the United States.
2. Scope
This policy applies to personal information we collect through the Services and offline when we communicate with you about a reservation. It does not apply to information handled under a separate notice (for example, a future vehicle purchase agreement or financing application) or to third-party websites we link to.
3. Notice at collection
The table below summarizes the categories of personal information we collect, where it comes from, why we use it, how long we keep it, and whether it is sold or shared. The categories follow those listed in the California Consumer Privacy Act (CCPA).
| Category | Examples | Source | Purposes | Retention | Sold / shared? |
|---|---|---|---|---|---|
| Identifiers | Name, email address, reservation number, IP address | You; your device | Process your reservation, communicate with you, security | Life of the reservation + 3 years | No |
| Customer records | Mailing address and phone number (if provided later), deposit transaction reference | You; our payment processor | Deposits, refunds, recordkeeping, legal compliance | 7 years after the transaction (tax and accounting) | No |
| Commercial information | Preferred trim, configuration, reservation and refund history | You | Production planning, allocation, customer service | Life of the reservation + 3 years | No |
| Geolocation (general) | ZIP code; approximate location derived from IP address | You; your device | Check delivery availability and state sales rules, fraud prevention | Life of the reservation + 3 years | No |
| Internet or network activity | Pages viewed, browser type, referring URL, consent choices | Your device, via cookies and similar technologies | Operate and secure the Site; analytics only with your consent | Up to 13 months | Only if you enable marketing cookies (see Section 7) |
| Inferences | Likely interest in a particular trim | Derived from the above | Improve product planning and communications | Life of the reservation | No |
We do not collect Social Security, driver's license or passport numbers, full payment card numbers, precise geolocation, biometric data or other sensitive personal information through the Site. Deposits are processed directly by a PCI DSS–compliant payment processor; we receive only a transaction reference, the last four digits of the card and its expiration date.
4. How we collect information
- Directly from you — when you submit the reservation form, email us, or respond to a survey.
- Automatically — when you use the Site, our servers and, if you consent, analytics tools record technical information about your device and visit. See our Cookie Policy.
- From service providers — for example, our payment processor confirms whether a deposit or refund succeeded.
5. How we use information
We use personal information to:
- receive, confirm, manage and refund reservations;
- send transactional messages about your reservation, the vehicle program and important changes;
- send product news and event invitations if you opted in (you can unsubscribe at any time);
- determine whether and how we can sell and deliver vehicles in your state;
- plan production and allocation;
- operate, maintain, secure and improve the Services, and detect and prevent fraud, spam and abuse;
- comply with law, respond to lawful requests, and establish, exercise or defend legal claims.
We will not use personal information for purposes that are materially different from those described here without notifying you and, where required, obtaining your consent.
6. How we disclose information
We disclose personal information only as follows:
- Service providers and contractors that process information on our behalf under written contracts restricting their use of it — for example, website hosting, email delivery, customer support tools, payment processing and, with your consent, analytics.
- Legal and safety — to comply with law, court orders or government requests, or to protect the rights, property and safety of Roadster, our users or others.
- Business transfers — in connection with a merger, financing, acquisition, reorganization or sale of assets, subject to this policy's protections.
- With your direction or consent.
7. Sale, sharing and targeted advertising
We do not sell personal information for money. We have not sold personal information in the preceding 12 months, and we do not knowingly sell or share the personal information of consumers under 16.
If you enable marketing cookies, advertising partners may collect online identifiers and activity data from the Site to measure campaigns and show you relevant ads elsewhere. Some state laws treat this as a “sale,” “sharing” or “targeted advertising.” Marketing cookies are off by default. You can opt out at any time by:
- visiting Your Privacy Choices;
- selecting Reject non-essential or turning off Marketing in ; or
- enabling a Global Privacy Control (GPC) signal in your browser. We treat GPC as a valid opt-out request for that browser.
We do not currently respond to “Do Not Track” browser signals, because there is no common industry standard for them; we do honor GPC as described above.
8. Cookies and similar technologies
We use cookies, local storage and similar technologies as described in our Cookie Policy. Non-essential technologies are only activated after you give consent, and you can change your choice at any time.
9. Data retention
We keep personal information only as long as needed for the purposes described in this policy, as shown in the table in Section 3. When a retention period ends, we delete or de-identify the information. We may keep information longer where required by law (for example, tax and accounting records) or to resolve disputes and enforce our agreements.
10. Your U.S. state privacy rights
Depending on where you live — including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia — you may have some or all of the following rights, subject to legal exceptions:
- Know / access — confirm whether we process your personal information and obtain the categories and specific pieces we hold, the sources, the purposes, and the categories of third parties we disclose it to.
- Portability — receive a copy of your personal information in a portable format.
- Correct inaccurate personal information.
- Delete personal information we collected from you.
- Opt out of the sale or sharing of personal information, targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects. (We do not engage in such profiling.)
- Limit the use of sensitive personal information. (We do not collect or use sensitive personal information for purposes that would require offering this right.)
- Appeal — if we decline to act on your request, you may appeal by replying to our decision or emailing [email protected] with “Appeal” in the subject. We will respond within the time required by law. If your appeal is denied, you may contact your state Attorney General.
- Non-discrimination — we will not deny you service, charge a different price, or provide a different quality of service because you exercised your privacy rights. Your place in the reservation queue is not affected.
11. How to exercise your rights
You or your authorized agent may submit a request by:
- using the request form on Your Privacy Choices;
- emailing [email protected].
Because we operate exclusively online and have a direct relationship with the people who reserve with us, we accept requests by email and through our online form.
Verification. To protect your information, we will verify your identity before fulfilling access, correction or deletion requests, typically by confirming control of the email address associated with your reservation. We will use information you provide for verification only for that purpose. Opt-out requests do not require verification.
Authorized agents. An authorized agent must provide signed permission from you or a valid power of attorney. We may still ask you to verify your identity directly.
Timing. We will confirm receipt within 10 business days and respond within 45 calendar days. If we need more time (up to an additional 45 days), we will tell you why. Requests are free of charge unless they are manifestly unfounded or excessive.
12. Additional California disclosures
Shine the Light. California Civil Code § 1798.83 permits California residents to request information about disclosures of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.
Financial incentives. We do not offer financial incentives in exchange for personal information. A reservation deposit is a refundable payment toward a potential vehicle purchase, not a financial incentive related to personal information.
13. Nevada residents
Nevada residents may submit a request to opt out of the sale of covered information under Nevada law by emailing [email protected]. We do not sell covered information as defined by Nevada law.
14. Children's privacy
The Services are intended for adults. You must be at least 18 years old to request a reservation. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of consumers under 16. If you believe a child has provided us with personal information, contact us and we will delete it.
15. Security
We use administrative, technical and physical safeguards designed to protect personal information, including encryption in transit (HTTPS), access controls and vendor due diligence. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we learn of a security incident affecting your personal information, we will notify you as required by law.
16. Email and other communications
Transactional emails about your reservation are part of the Services. Marketing emails are sent only if you opt in, and every marketing email includes an unsubscribe link, consistent with the CAN-SPAM Act. Unsubscribing from marketing does not stop transactional messages about an active reservation.
We do not send text messages or make marketing calls without your prior express written consent.
17. Third-party links
The Site may link to websites or services operated by others, such as our payment processor. Their privacy practices are governed by their own policies, and we encourage you to read them.
18. Changes to this policy
We may update this policy from time to time. We will post the updated version with a new “Last updated” date and, for material changes, notify reservation holders by email before the change takes effect.
